Competition terms and conditions

There are four prizes available in the Brooke and Hannah Russell Skilled Competition. Two winners will be chosen from Instagram entries. Two winners will be chosen from Facebook entries.

By entering into the Skilled Competition entrants agree to be bound by the terms and conditions below (“Terms and Conditions”) which consist of:

‘General Terms and Conditions’ which apply to the Brooke and Hannah Russell Skilled Competition unless stated otherwise; and

Any references to the ‘Skilled Competition’ means the Brooke and Hannah Russell Prize competition you are entering.

General terms and conditions

Eligibility

1.       The Skilled Competition is open to UK residents aged 13 or over.

2.       The Skilled Competition is not open to Brooke employees, or to any other third party directly connected with or involved in the administration of the Skilled Competition (including any prize donors). Together with their immediate family members and/or personal partners.

3.       Brooke reserves the right to request evidence of eligibility, including the identity and age of any entrant.

How to enter

4.       Entry to the Skilled Competition opens 29 January 2024 at 11am UK time and closes 02 February 12pm UK time (“Entry Period”). Entries received outside the Entry Period will not be valid and will not be entered into the Skilled Competition.

5.       All entries are free.

6.       Entries to the Skilled Competition must be submitted by:

a.       answering the question posed on the Facebook and/or Instagram competition post in the comments section of that post;

b.      and following both Brooke and Hannah Russell

7.       Any entries that do not fulfil both of the above criteria will be disqualified.

8.       One answer in the comments section of the Facebook or Instagram competition post will equal one entry.

9.       Entrants may submit more than one entry but they must be submitted as a separate comment on the Facebook and/or Instagram competition post.

10.   Entries must be made directly by the person entering the Skilled Competition. Brooke will not accept third party, bulk and/or automated applications.

11.   It is the entrant’s responsibility to ensure that their personal entry details are correct and complete. Brooke will not be liable for any inaccuracies to an entrant’s personal or Facebook or Instagram details when selecting the winner. Brooke is not liable for issues of any kind which may prevent, restrict or delay the sending or receipt of an entry. Including (but not limited to) technical faults such as network, computer, hardware or software failures. Late, damaged, illegible or corrupt entries, or those not complying with these Terms and Conditions, will not be valid. Proof of posting or transmission is not proof of receipt by Brooke.

Prizes

12.   There are four individual prizes in total available for the competition. Two individual prizes on Facebook. Two individual prizes on Instagram. Full details of which are set out in the Prize Specific Terms and Conditions below.

13.   The provision of any prize does not imply endorsement by Brooke of any third parties concerned in any way with the Skilled Competition.

14.   The winner is responsible for any personal or incidental expenses and any VAT, national and/or local tax liabilities that may be incurred in claiming or using the prize.

15.   Unless stated otherwise in the prize description, the prize is to be claimed by winners and concluded by 01 March 2024. All prizes are subject to availability.

16.   Each prize is non-transferable, non-refundable and non-negotiable. In the event of circumstances beyond Brooke’s reasonable control, Brooke reserves the right to substitute a prize for a similar prize of equal or greater value.

17.   By participating, entrants agree that the prize is awarded on an “as is” basis and that Brooke makes no representations or gives no warranties of any nature in relation to the prize.

18.   Each prize is taken at the winner's own risk and Brooke accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by the winner as a result of entering the Skilled Competition or accepting the prize. Brooke also disclaims liability for any injury or damage to an entrant’s (or any other person's) computer relating to or resulting from participation in or downloading any materials in connection with the Skilled Competition. Nothing in these Terms and Conditions shall exclude Brooke’s liability for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.

Winner selection

19.   Brooke’s Digital Officer and an Independent Judge will judge each entry based on:

a.       Creativity; and

b.      How well it answers the questions posed on the Facebook or Instagram competition post.

20.   The winner will be chosen on 04 February 2024 (“Draw Date”). Reserve winners will also be selected in case the original winner cannot be contacted and/or do not provide the necessary contact information. Brooke’s decision will be final and Brooke will not engage in any correspondence about the validity of the winner.

21.   The winner will be notified within seven days of the Draw Date via Facebook or Instagram direct message using the Facebook or Instagram name used by the winner for entry. The winner notification will contain details about how to claim the prize.

22.   If a winner cannot be contacted or fails to respond to communications within 21 days of notification, the prize will be forfeited and Brooke reserves the right to award a prize to a reserve winner selected as set out above.

23.   Brooke reserves the right to disqualify a winner if it reasonably believes there has been a breach of these Terms and Conditions or a winner’s conduct is contrary to these Terms and Conditions. In these circumstances Brooke also reserves the right to require the return of any prize awarded (if applicable) and select an alternative winner as set out above.

24.   Each winner will be required to provide relevant information in order to assist Brooke in arranging and administering the prize. Including but not limited to proof of age of the winner, postal address and email address required in order to administer the prize. Further details will be set out in the winner notification. This data will be deleted upon completion of administering the competition prize.

General

25.   Brooke reserves the right to (i) cancel or suspend the Skilled Competition; (ii) cancel or refuse any individual’s entry and (iii) amend these Terms and Conditions (we will use reasonable endeavours to notify changes to entrants and potential entrants).

26.   Any personal data received from entrants will only be used and/or shared with third parties where necessary for the proper administration of the Skilled Competition and release of the prize, including for the purpose described in paragraphs 21 and 22 and in accordance with applicable data protection legislation. Further information on how we will use and process your data can be found in Brooke’s Privacy Policy.

27.   The winner acknowledges that Brooke may request their consent to participate in promotional activity and material relating to the Skilled Competition. However, for the avoidance of doubt neither entry into the Skilled Competition nor the likelihood of the entrant being the prize winner are conditional upon consent being given.

28.   The winner's Facebook or Instagram handle name will be available for one month after the Draw Date to anyone who sends their address and the name of the Skilled Competition to the following address: The Brooke and Hannah Russell Skilled Competition, Brooke, 2nd Floor, The Hallmark Building, 52-56 Leadenhall Street, London, EC3A 2BJ. If the winner objects to this information being made available to the public, they must inform Brooke at the earliest opportunity. In such cases, Brooke will not make their details available to members of the public but the winner acknowledges that Brooke may still be required to share their details with the Advertising Standards Authority.

29.   These Terms and Conditions shall be governed and construed in accordance with English law and entrants agree to irrevocably submit to the exclusive jurisdiction of the English courts in respect of any dispute arising out of or in connection with them.

Prize specific terms and conditions

1.       The prize must be claimed within 21 days of the winner being contacted to be told they have won.

2.       Prize description: The prize is one of Hannah Russell’s ‘Little Alf’s Adventure Around the World’ book (which can be seen at https://www.hannahlittlealfandfriends.com/product-page/little-alf-s-adventure-around-the-world-book. Two winners will be selected from Instagram. Two winners will be selected from Facebook.
